This document sets forth the legal terms for using the Priority Help Car platform as a CLIENT. By registering and using this service, YOU FULLY ACCEPT these terms and expressly acknowledge that:
These Terms govern your access to and use of the Priority Help Car mobile application and/or website (hereinafter "Priority Help Car"). By accessing and using the Platform, you agree to and are bound by these Conditions, thereby establishing a contractual relationship between you and Priority Help Car.
The service provided by Priority Help Car consists of:
These Terms expressly supersede any prior agreement or arrangement that may have existed between you and Priority Help Car.
These Conditions apply to your use of the Platform Services in Spain. If you access or use the services from another country, you may be subject to specific terms for that jurisdiction, which shall prevail.
⚠️ IMPORTANT: Priority Help Car does NOT provide vehicular services (tow trucks, roadside assistance, mobile workshops, vehicle transport, or any other related service). Priority Help Car operates exclusively as a technology connection platform to facilitate Providers (third parties) in providing services directly to you.
Our role is limited to:
All Providers are independent contractors, registered companies, or other legal entities who are NOT employed by Priority Help Car.
Priority Help Car does NOT:
Providers (Third Parties) are free to decide whether or not to respond to your request by sending you an offer/quote.
When a Provider sends you an offer and you accept it, a direct service contract is established between you and the Provider.
Priority Help Car is not a party to this contract and therefore assumes no responsibilities or obligations arising from the service that the Provider renders directly.
You agree that upon completion of the service, you may be requested to rate the Provider. This rating system is used to maintain the quality of service offered and may be visible to other Clients and to the Provider.
Priority Help Car expressly declares that its service is strictly and exclusively limited to the provision of electronic communication protocols and geolocation.
Priority Help Car acts as an "Information Society Intermediary Service Provider" in accordance with applicable legislation for information society services (LSSI in Spain, DSA in the European Union, or equivalent regulations in other jurisdictions).

Therefore, Priority Help Car's service is functionally equivalent to a messaging tool or dynamic telephone directory, and does not constitute a transport, logistics, or roadside assistance service.

The Client confirms possession of full legal capacity required for contracting services (being of legal age, 18 years or older).
Use of the Platform is PROHIBITED for minors under 18 years of age. If a minor accesses and uses the Platform, the parents, guardians, or legal representatives shall be solely responsible for all activities and any damage or harm that may arise, including compliance with these Terms. Priority Help Car may request age verification at any time.

Priority Help Car may suspend or cancel your account temporarily or permanently if:
Priority Help Car may (without any obligation), at its sole discretion and in specific cases it deems necessary, request identity verification, additional information, or supporting documentation.
The request for or spot verification in some cases does NOT constitute an obligation on Priority Help Car's part to verify all users nor does it guarantee that all users have been verified.
As a technology intermediary, Priority Help Car is NOT responsible for:
In the exceptional case that Priority Help Car is legally declared liable for direct damage caused by a platform defect, our maximum liability is limited to the lesser of:

Priority Help Car shall NOT be liable for:
Priority Help Car offers client_free, client_basic, and client_unlimited plans. Details and rates are available on the platform and may be modified.
Priority Help Car may offer a free trial period of 14 days for the client_unlimited plan or other premium modality. If the Client does not cancel the trial before its expiration, the subscription will automatically renew to the standard paid plan, unless a transition to the client_free plan is specified upon trial completion. If you subscribe to a paid plan after the trial, full payment terms will apply.
Any changes to rates or important features will be notified 30 days in advance. If you continue using the service after notification, you accept the changes.
Subscriptions are processed exclusively through Google Play Store or Apple App Store. You accept the payment and billing terms of these stores:

Priority Help Car does NOT manage payments between Clients and Providers for vehicular services rendered. You are responsible for paying the Provider directly as agreed between both parties.
Access to the client_free (free) plan includes the obligation to view advertising and/or participate in the rewarded advertising program in order to access certain functionalities or services within the Platform.
To request a service:
⚠️ Priority Help Car does NOT automatically assign providers. You choose freely.
The Provider will receive the notification and may send you an offer/quote. You decide whether to accept or reject the offer.
Free Plan (client_free): 1 request per month
Basic Plan (client_basic): According to contracted plan terms
Unlimited Plan (client_unlimited): No limits
Once the limit is reached, you must upgrade your plan.
Before accepting the Provider's offer: You may cancel your request at any time without penalty as long as you have not accepted the Provider's offer/quote.
After accepting the Provider's offer: Once you accept the Provider's offer, a service commitment is established. Any cancellation must be managed directly with the Provider. Cancellation conditions (including possible penalties or refunds) shall be those agreed between you and the Provider.
Priority Help Car does not intervene in cancellations once you have accepted a Provider's offer.
Priority Help Car does NOT guarantee immediate Provider availability or specific response times. If you do not receive a response, we will only notify you of the request status.

By accepting these terms, you acknowledge and agree that:
Priority Help Car is NOT a party to the contract between you and the Provider, and therefore does NOT act as mediator, arbitrator, or responsible party for disputes related to the service provided.

In case of legal or administrative proceedings, Priority Help Car may provide Provider data to competent authorities or to the Client upon request, provided there is a legal basis for doing so.
By using Priority Help Car, you agree that we collect and share your GPS location and personal data necessary to facilitate connection with Providers and service provision.

The service is provided "AS IS" and "AS AVAILABLE", without warranties of any kind regarding availability, absence of errors, or fitness for a specific purpose.
Priority Help Car does not warrant that the service will be uninterrupted, secure, error-free, or that it will meet your expectations. Any use of the service is at your own risk.
Priority Help Car may include links to third-party applications, tools, or services. Such services are entirely independent from Priority Help Car, which does not participate in their development, maintenance, or operation, nor assumes any responsibility for their content, accuracy, legality, or results derived from their use.
Access to and use of these external applications is at the user's sole responsibility.
We reserve all rights to the Platform, including its code, design, trade names, and logos. Use of the Platform grants you a limited, non-transferable, and non-exclusive license for personal use.
You may not, without our express permission:
(a) Copy, modify, distribute, sell, or lease any part of the Platform.
(b) Reverse engineer or attempt to extract the source code of the Platform.
(c) Extract data through scraping, indexing, or any other automated method.
(d) Use our Names or Trademarks (including Priority Help Car and Priority Help Car) in advertising, domains, application names, or social profiles that would be confusing or substantially similar to ours.
(e) Purchase keywords (such as Google AdWords) containing our Names or Trademarks.
You agree to indemnify and hold harmless Priority Help Car, its officers, and employees from:

Priority Help Car acts as Data Controller of your personal data in accordance with the General Data Protection Regulation (GDPR) and applicable data protection legislation.

Priority Help Car shall not be liable for breaches caused by events beyond our control: internet failures, natural disasters, pandemics, fires, floods, strikes, or third-party service interruptions.
If any provision is declared invalid, the remainder shall remain in effect.
The fact that Priority Help Car does not exercise a right does not constitute a waiver thereof.
Priority Help Car may modify these terms at any time. Changes will take effect immediately upon publication on the platform.
We will notify you of important changes. If you continue using the platform after the changes, you accept the new terms.
You MAY NOT assign these terms.
Priority Help Car may freely assign its rights and obligations to any third party (including acquirers, mergers, or successors) without your consent, provided that the assignee entity maintains Priority Help Car's obligations.
These terms are governed by the laws of Spain.
Disputes related to these terms shall be submitted to the exclusive jurisdiction of the courts of Madrid, Spain.
Notwithstanding the foregoing, if you are a consumer resident in the European Union, you may file claims before the courts of your place of residence as established in the Brussels I bis Regulation.

You agree that all disputes will be resolved individually, not as part of a class or group action. This waiver shall be effective to the maximum extent permitted by applicable law. In the event a court determines that this clause is not applicable or enforceable, the remainder of the terms shall remain in effect.

By registering as a client with Priority Help Car, YOU DECLARE THAT:
